Section 78R of the Environmental Protection Act 1990 as amended by the Environment Act 1995 (Part IIA), requires each enforcing authority to keep a Public Register of ‘Contaminated Land’.
The register is intended to act as a full and permanent record, open for public inspection, of all regulatory action taken by the enforcing authority in respect of the remediation of contaminated land, and will include information about the condition of the land [DETR Circular 02/2000].
Schedule 3 of the Regulations gives full detail of the information that is to be maintained on the Register.
Where a Remediation Notice is served (under Regulation 15 and Schedule 3) the Council is required to record information on the Site itself and Remediation that is required. For Remediation declarations, Remediation Statements and Notifications of claimed remediation (under section 78R(1)(h) or (j) similar information is required. Where a site is dealt with under other Environmental Controls, but is formally identified as ‘contaminated land’, information is also required to be held.
To date we have not formally designated any sites as ‘contaminated land’ under the Part IIA definition.
